Formation of Contract Between You and Us
Our site is intended for use by individuals registered with us and residing in Great Britain and Northern Ireland. We reserve the right to accept or reject orders from individuals outside of these territories at our sole discretion.
A contract between you and SellYourGadget.com will be formed when we receive your sell order. This contract will include these terms and conditions and our terms of use. For more information, please visit the “How It Works” page on our site.
You must own all rights, title, and interest in any devices (including but not limited to phones, tablets, smartwatches, gaming consoles, and laptops) that you send to us.
Ownership of the device(s) will transfer to us when we receive them and dispatch payment to you, at which point the contract will be binding.
This contract is binding on you, us, and our respective successors and assigns. You may not transfer, assign, charge, or dispose of this contract or any rights or obligations without our prior written consent.
We reserve the right to transfer, assign, charge, sub-contract, or dispose of any contract or rights or obligations arising under it at any time during the term of the contract.
Cancellation Rights
You may cancel this contract at any time before you send your device(s) to us during the “cooling-off period.” The cooling-off period applies if:
- The contract was concluded solely through distance communication (e.g., online, by phone, email, etc.); and
- You are a consumer acting outside of any business purposes.
During the cooling-off period, you may cancel without providing a reason or incurring any administrative fees. To cancel, please notify us in writing.
Once you send your device to us, the cooling-off period ends, and cancellation is not possible unless the device fails to meet the terms and conditions outlined below.
Eligibility to Sell Devices
By placing an order through our site, you warrant that:
- You are a resident of Great Britain or Northern Ireland;
- You are accessing our site from within these territories;
- You are legally capable of entering into a binding contract; and
- You are at least 18 years old, or if you are under 18, you have obtained consent from a parent or guardian to sell your device to us.
You and your parents or guardians release us from any liability if you breach this warranty.
Consumer vs Business Transactions
If you are a consumer (an individual acting outside of a business context), the provisions of this contract that are not applicable to consumers shall not apply to you. This contract does not affect your statutory rights.
If you are acting on behalf of a business, you must warrant that you are authorized to sell the device(s) and that the business is located in Great Britain or Northern Ireland.
Device Condition Guidelines
To be eligible for sale, each device (including phones, tablets, smartwatches, gaming consoles, and laptops) must meet the following conditions:
- Mobile Phones
- Excellent Condition: Minor scratches (up to 3 on the screen, up to 5 on housing), no cracks or dents, fully functional with no liquid damage, and battery health at least 80%.
- Good Condition: More than 3 light scratches, minor scuffs/dents, but fully functional with no liquid damage.
- Faulty Condition: Cracked screen, non-functional buttons, liquid damage, or other operational issues.
- Tablets
- Excellent Condition: Fully functional with light signs of use, no cracks or significant damage, battery health at least 80%.
- Good Condition: Heavier signs of use, no cracks or deep scratches, fully functional with battery health at least 80%.
- Faulty Condition: Functional faults, display damage, liquid damage, or issues with buttons and ports.
- Laptops and MacBooks
- Excellent Condition: Fully functional with no damage, screen in perfect condition, battery health at least 80%.
- Good Condition: Light scratches or scuffs, fully functional with no liquid damage.
- Faulty Condition: Issues with charging, display, or internal components.
- Gaming Consoles and Accessories
- Excellent Condition: Fully functional, with no damage and all original accessories included.
- Good Condition: Heavier signs of use, fully functional with minor scratches or dents.
- Faulty Condition: Does not boot, issues with ports or display, or missing accessories.
- Smartwatches
- Excellent Condition: Fully functional with no physical or liquid damage, battery health at least 80%.
- Good Condition: Signs of use, missing or damaged accessories, battery health at least 80%.
- Faulty Condition: Functional faults or physical damage, such as screen damage, faulty buttons, or liquid exposure.
Data Risks and Precautions
By sending your device to us, you agree to release us from any liability regarding the device, any data stored on it, or any other media associated with it. We do not assume responsibility for the security or use of your data. It is your responsibility to ensure that all data is removed from the device before sending it to us.
We cannot be held liable for any loss of data. We recommend that you perform a factory reset and delete all personal information before shipping your device.
Device Value Adjustments
If we determine that the device does not meet the condition specified in your order, we will send you an updated offer. If you do not respond to this new offer within 14 days, we will process the payment based on the adjusted value.
Final Decision
We reserve the right to make the final decision on the value of your device. If you disagree with our adjusted offer, we will return your device to you.
By submitting an order through our site, you confirm that your device meets the conditions outlined above.

Device Preparation
If your device is functional, we strongly recommend deleting all personal data before sending it to us. You can use our free Mobile Data Delete Tool to guide you through the process of data removal.
If your device is non-functional and has a “remote wipe” feature, we strongly advise you attempt wiping the device before sending it to us.
For non-functional devices with a PIN lock (password or combination required to access the device), this will block third-party access, and anyone repairing the device will need to reset it to factory settings, thus deleting all data.
Please note: If a non-functional device cannot be wiped but is sent to us, there may still be data on the device that could be accessed by repair personnel.
SIM Card Removal
Please cancel any airtime contract linked to your device. We are not responsible for any call charges before or after receiving the device.
Make sure to remove your SIM card before sending the device. We will not be liable for any charges incurred if a SIM card is sent with the device. SIM cards cannot be returned.
Lost or Stolen Devices
Selling a mobile phone or device you do not own could be a criminal offense. We check all IMEI/Serial numbers with CheckMEND to ensure devices are not lost or stolen.
If we find a device has been reported as lost or stolen, we will notify you and place the device in quarantine for 28 days. During this period, you must provide proof of ownership or clear the device from the CheckMEND database. If the device is not cleared by the end of the quarantine, it will be reported to the police or properly disposed of.
Pricing
Prices on our website are subject to change without notice. Once your order is placed, the price is guaranteed for 14 days. If your device arrives after 14 days, updated prices will apply.
Postage and Packaging
We offer several posting options, including Royal Mail and a free postage bag. Please ensure your device is packaged correctly to avoid any loss or damage. We recommend using tracked services for valuable devices.
Payments
You can choose to be paid by cheque, bank transfer, or gift e-card when selling your device. Once we confirm your device meets our terms, we will process your payment the same day (Monday to Friday). Payment options cannot be changed after the order is placed.
Important Notes Regarding Lost or Stolen Devices
We do not pay for devices that are reported as stolen or lost according to the CheckMEND database. If a device is flagged, it will be held for 28 days, and we will need proof of ownership to process payment.
Apple and Google Activation Locks
If your device is activation-locked, we will contact you with instructions on how to remove the lock. Devices with an activation lock will be held for up to 42 days, and after that period, they will be responsibly recycled.
Counterfeit Devices
If a counterfeit device is received, we will not make a payment for it. We may return it to you at your expense or dispose of it responsibly.
